These Terms of Service ("Terms") govern your access to and use of GoViraleza ("the Service", "we", "us", or "our"), operated by GoViraleza. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and GoViraleza. You represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

GoViraleza is a software-as-a-service (SaaS) platform that provides AI-powered social media content creation tools, including but not limited to caption generation, image selection, competitor analysis, analytics, and scheduling integration. The Service relies on third-party APIs and services including but not limited to Cerebras AI, Pixabay, Buffer, Google Gemini, and Instagram public data.

3. Account Responsibilities

You are solely responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring that your use of the Service complies with all applicable laws and regulations
  • The accuracy and legality of all content you create, publish, or schedule through the Service
  • Obtaining any necessary rights, permissions, or licenses for content you upload or distribute
  • Any API keys or access tokens you connect to the Service

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.

4. User Content and Conduct

You retain ownership of all content you create through the Service. However, you grant GoViraleza a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the Service.

You agree not to use the Service to:

  • Create, distribute, or promote content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Violate any intellectual property rights of third parties
  • Impersonate any person or entity
  • Distribute spam, malware, or other harmful content
  • Attempt to gain unauthorized access to any systems or accounts
  • Violate the terms of service of any third-party platform, including Instagram and Buffer
  • Scrape, harvest, or collect data from the Service beyond normal use
  • Reverse engineer, decompile, or disassemble any part of the Service

5. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate captions, hooks, hashtags, and content suggestions. You acknowledge and agree that:

  • AI-generated content may contain errors, inaccuracies, or inappropriate material
  • You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing
  • GoViraleza does not guarantee the accuracy, quality, originality, or suitability of any AI-generated content
  • AI-generated content may inadvertently infringe on third-party intellectual property rights, and you are solely responsible for verifying originality
  • We are not responsible for any consequences arising from your use or publication of AI-generated content
  • AI models may produce different results over time and we make no guarantees about consistency

6. Third-Party Services

The Service integrates with third-party services including Instagram, Buffer, Pixabay, Cerebras AI, and Google Gemini. You acknowledge that:

  • We are not responsible for the availability, accuracy, or performance of any third-party service
  • Your use of third-party services is subject to their respective terms of service and privacy policies
  • Third-party services may change, limit, or discontinue their APIs at any time, which may affect the functionality of our Service
  • We are not liable for any data loss, service interruption, or damages caused by third-party services
  • API rate limits imposed by third-party services may temporarily restrict functionality

7. Instagram Data and Scraping

The Service accesses publicly available Instagram data for competitor analysis. You acknowledge that:

  • We access only publicly available profile information and post data
  • The accuracy of scraped data depends on Instagram's public availability and may be incomplete or outdated
  • You are responsible for ensuring your use of competitor data complies with applicable laws
  • Instagram may block or limit data access at any time, and we are not responsible for resulting service limitations

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any content generated by the Service will be suitable for your purposes
  • Any defects in the Service will be corrected
  • The Service will meet your specific requirements or expectations
  • The Service will increase your followers, engagement, or revenue

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOVIRALEZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or business opportunities
  • Damage to reputation or goodwill
  • Cost of procurement of substitute services
  • Any damages resulting from AI-generated content
  • Any damages resulting from third-party service failures
  • Any damages resulting from unauthorized access to your account

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100 USD), WHICHEVER IS LESS.

10. Indemnification

You agree to indemnify, defend, and hold harmless GoViraleza, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of any third party
  • Any content you create, publish, or distribute using the Service
  • Your violation of any applicable law or regulation
  • Any claim by a third party related to content you published using the Service

11. Intellectual Property

The Service, including its design, code, features, and documentation, is the intellectual property of GoViraleza and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

12. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. We are not liable to you or any third party for any termination of your access to the Service. You may delete your account at any time.

13. Beta Service

The Service is currently in beta. Beta features may be unstable, incomplete, or subject to change without notice. We may add, modify, or remove features at any time. No service level agreement (SLA) is provided during beta.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits or class-wide arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and GoViraleza regarding the Service and supersede all prior agreements, representations, and understandings.
